5. HOW TO SEND A COPYRIGHT (DMCA) NOTICE

Madame D XXX respects intellectual-property rights.

If you believe material appearing on this website infringes a copyright you own or are authorized to enforce, you may send a written copyright notice. Where applicable, copyright notices will be handled in accordance with United States copyright law and the Digital Millennium Copyright Act (“DMCA”).

Your notice should include:

  • Your physical or electronic signature, as the copyright owner or a person authorized to act on the owner’s behalf;

  • Identification of the copyrighted work you believe has been infringed (or, if one notice covers several works, a representative list of them);

  • Identification of the material you believe is infringing, with information reasonably sufficient for us to locate it, such as the direct link (URL) to the page where it appears;

  • Your contact information, including your name, mailing address, telephone number, and email address;

  • A statement that you have a good-faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and

  • A statement that the information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or are authorized to act on the copyright owner’s behalf.

We may ask you for missing information before acting on a notice.

Send your notice through the Contact page and write “DMCA Notice” in the Subject field.

6. COUNTER-NOTICES

If material you provided was removed from this website or access to it was disabled because of a copyright notice, and you believe this happened by mistake or because the material was misidentified, you may send a written counter-notice through the Contact page. Write “DMCA Counter-Notice” in the Subject field.

Your counter-notice should include:

  • Your physical or electronic signature;

  • Identification of the material that was removed or disabled and where it appeared before it was removed or disabled;

  • A statement, under penalty of perjury, that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification;

  • Your name, mailing address, and telephone number; and

  • A statement that you consent to the jurisdiction of the federal district court for the judicial district where your address is located (or, if your address is outside the United States, any judicial district in which Madame D XXX may be found), and that you will accept service of process from the person who sent the original notice or that person’s agent.

If we receive a valid counter-notice, we may send a copy to the person who sent the original notice. Unless that person first tells us that they have filed a court action about the material, the material may be restored no sooner than 10 and no later than 14 business days after we receive the counter-notice, as permitted by law.

7. FALSE OR MISLEADING CLAIMS

Under United States law (17 U.S.C. § 512(f)), a person who knowingly and materially misrepresents that material is infringing, or that material was removed by mistake or misidentification, may be liable for damages, including costs and attorneys’ fees.

8. REPEAT INFRINGERS

Madame D XXX may, in appropriate circumstances, suspend or terminate the access of any member or other user who repeatedly infringes copyrights.

A single instance of unauthorized copying or distribution may also result in termination of access, as described in Section 3.

Access ended for infringement or unauthorized distribution is not eligible for a refund.

Termination does not give anyone the right to keep, distribute, reproduce, or continue using copyrighted material obtained through the website.

9. CHANGES TO THIS POLICY

This Copyright & DMCA Policy may be updated from time to time. The current effective date will appear at the top of this page.

10. CONTACT AND RELATED POLICIES
